I think this is from Drought Conditions.

The anger seemed in character for both of them, but the violence
seemed a little out to me. Although I think Toby had that bar
fight.

And I can't help but wonder if Toby's character is being set up here
for his later problems.

I thought it was interesting how CJ picked a replacement for Josh.
Getting more or less the same answers on questions about legislation,
even thought the two people are on opposites sides of the aisle.

I didn't. The had to be a better candidant somewhere. He was just
the most interesting one we've seen already.

Answers to questions about how people will act that won't change. The
problem is someone from the other side of the aisle isn't going to
want to push for what you want.

True, it did.
I wonder if the fight was a way for the writers to tell us why Josh
didn't ask Toby. Maybe there's always been some underlying tension.
Maybe why Josh thought that Toby was angling for the CoS job.

I'm not sure if that was it. I think he was in a bar on a trip to CA
with the president, and someone threatened Andy and Toby and Charlie
ended up going to jail. I think The California 47th.

Because when Josh said he was going to groom Santos, Toby got angry
that he was abandoning Bartlett. At that point, Josh assumed Toby
wasn't interested in living Bartlet.

No, she wanted to know how to get the act passed. The fact that Josh
said the same thing as aliteratively initialed Cliff, made her realise
he was as good as him.

All people's answers are tainted by something. Josh and Cliff are
pragmatists, though.

The bar fight was in Season 4 ("Red Haven's on Fire" - Sam Seaborn's last regular
episode). Toby was defending his ex. Andy (Congressman Wyatt), who had been
heckled in the bar by a conservative couple for having become pregnant out of
wedlock. Apparently, a push came to a shove, and Charlie came to assist, and both
(Toby & Charlie) ended up "under arrest."

As for the anger/violence in Drought Conditions, I simply think it was Toby's grief/rage
over the loss of his brother, whom we learned in this episode had committed suicide
at the news that he had cancer. Where Josh's anger is coming from, I'm not so sure.
But as we've seen from day 1, Josh doesn't need all that much "baiting" to get into
something if he wants to.

Certainly the death of his brother, and the fact that he was an Astronaut come into
play. It would seem plausible that Toby would be on the side of "rescuing" the
Astronauts, whatever that took (when it seemed that for "military/secrecy" reasons,
the government was willing to sacrifice their lives).
